03/23/2022 Order In light of recent developments reported in the press bearing or potentially bearing upon issues raised in this appeal, Appellants shall file a status update no later than April 1, 2022. The status update shall specifically address whether all or any part of this appeal has been rendered moot. See Bd. of License Com’rs of Town of Tiverton v. Pastore, 469 U.S. 238, 240 (1985) (reminding counsel of their continuing duty to keep the court informed “without delay” of any developments that could affect the Court’s jurisdiction or render a case moot); Merkle v. Guardianship of Jacoby, 912 So. 2d 595, 600 (Fla. 2d DCA 2005) (citing counsel’s duty of candor to the court under R. Regulating Fla. Bar 4–3.3, and noting that “[d]uring the pendency of an appeal, the duty of candor imposes an obligation on counsel to notify the court of any development that may conceivably affect the outcome of the litigation, including facts that may raise a question of mootness”). Appellees may file their own status update within five days thereafter. No reply will be permitted. The parties shall attach to their respective responses to this order true and accurate copies of any documents referenced in such responses. The parties’ status updates shall not include additional argument on the merits of the appeal. Failure to respond timely to this order may result in the imposition of sanctions including dismissal of the appeal without further opportunity to be heard and referral of the matter to The Florida Bar.
